1. AGREEMENT TO TERMS
These Terms and Conditions ("Terms," "Terms and Conditions") constitute a legally binding agreement between you ("User," "you," or "your") and the Townsville Zim Community ("we," "us," or "our") concerning your access to and use of the https://www.townsvillezimcommunity.com/ website (the "Website").
By accessing or using the Website, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with these Terms, you must not access or use the Website.
We reserve the right to modify these Terms at any time. Your continued use of the Website following any changes indicates your acceptance of the new Terms.

2. ABOUT THE TOWNSVILLE ZIM COMMUNITY
The Townsville Zim Community is a community organisation that brings together individuals and families with Zimbabwean heritage living in Townsville, Queensland, Australia. We organise cultural events, social gatherings, and community activities to celebrate our shared heritage and foster connections. Examples of cultural events are events about a public holiday of cultural significance and events showcasing cultural food/music. 

 

The Townsville Zim Community promotes integration of people into the Townsville community and is aligned with the Townsville City Council's Diversity and Inclusion Strategy (Townsville City Council  Diversity and Inclusion Strategy 2020-2024).
We are a not-for-profit community organisation. Our Website is provided to facilitate community engagement, event organisation, and information sharing.

3. ELIGIBILITY AND USE OF THE WEBSITE
3.1 Eligibility
You must be at least 18 years of age to register an account or submit information on behalf of your family. If you are under 18, you may only use the Website with the involvement and consent of a parent or legal guardian.

 

3.2 Account Registration
To access certain features of the Website (such as family registration, event RSVPs), you may be required to create an account or provide personal information. You agree to:

Violation of these prohibitions may result in immediate termination of your access to the Website and may subject you to civil and/or criminal liability.

5. EVENT PARTICIPATION

5.1 Event Registration and RSVPs
When you register for or RSVP to community events:

  • You agree to provide accurate information about attendees

  • You acknowledge that event details (date, time, location, cost) are subject to change

  • You agree to notify us promptly if you can no longer attend

 

5.2 Event Fees
Where events require payment:

  • All fees must be paid by the specified deadline

  • Refund policies vary by event and will be communicated at the time of registration

  • We reserve the right to cancel your registration if payment is not received

 

5.3 Event Conduct
All event participants must:

  • Behave respectfully towards other attendees, organisers, and venue staff

  • Follow all venue rules and Australian laws

  • Supervise their children at all times (parents/guardians are responsible for their children's behaviour)

  • Respect cultural sensitivities and community values

 

5.4 Health and Safety

  • You are responsible for informing us of any medical conditions, allergies, or dietary requirements relevant to event participation

  • You participate in events at your own risk

  • We recommend appropriate insurance coverage for event participation

  • Parents/guardians are responsible for their children's safety at all events

5.5 Event Cancellation or Modification
We reserve the right to:

  • Cancel, postpone, or modify any event due to circumstances beyond our control (including weather, venue issues, insufficient registrations, or public health concerns)

  • Refuse admission to any event

  • Remove participants who violate these Terms or engage in inappropriate behaviour

  • In the event of cancellation, we will make reasonable efforts to notify registered participants and, where applicable, provide refunds or credits.

6. DONATIONS AND PAYMENTS
6.1 Donations

  • Donations to the Townsville Zim Community are voluntary and support our community activities, events, and services.

  • All donations are final and non-refundable unless otherwise required by law

  • We will provide tax receipts for eligible donations in accordance with Australian tax law

  • Donations are processed through secure third-party payment processors

 

6.2 Payment Processing

  • Payment information is processed by third-party payment processors and is subject to their terms and privacy policies

  • We do not store complete credit card information on our servers

  • You are responsible for any fees charged by your financial institution

 

6.3 Currency
All prices and fees are in Australian Dollars (AUD) unless otherwise stated.

7. INTELLECTUAL PROPERTY RIGHTS

12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless TOWNSVILLE ZIMBABWE COMMUNITY INCORPORATED (the Townsville Zim Community), its committee members, volunteers, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from:

  • Your use or misuse of the Website

  • Your violation of these Terms

  • Your violation of any rights of another party

  • Your conduct at community events

  • Any content you submit or post to the Website

  • Your breach of any applicable laws or regulations

  • This indemnification obligation will survive the termination of these Terms.

Before commencing legal proceedings, you agree to attempt to resolve disputes through mediation or another appropriate alternative dispute resolution process.

15. GENERAL PROVISIONS
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TOWNSVILLE ZIMBABWE COMMUNITY INCORPORATED (the Townsville Zim Community) regarding your use of the Website and supersede all prior agreements and understandings.


15.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

15.6 No Agency
No agency, partnership, joint venture, or employment relationship is created between you and TOWNSVILLE ZIMBABWE COMMUNITY INCORPORATED (the Townsville Zim Community) as a result of these Terms or your use of the Website.


15.7 Headings
The headings in these Terms are for convenience only and have no legal or contractual effect.


15.8 Notices
